§1

Personal data protection

  1. Customer’s personal data collected from www.genoscope.pl shop is used by "GENOSCOPE" sp. z o.o. sp.k.
  2. Personal data will be used only in the following purposes:
    1. to process orders,
    2. in case of registration - to use online service,
    3. for marketing purposes(only with customer’s consent),
  3. Customers give their personal data voluntarily, however, in case of refusal it can unable "GENOSCOPE" sp. z o.o. sp.k. to process orders properly.
  4. Customers have the right to access their personal data and to correct them.
  5. Customers have the right to complete and update their personal data, and also to demand that the data be removed from the website www.genoscope.pl in the “Login” tab - if they are incomplete, out-of-date, untrue or collected unfairly or unlawfully. Collected personal data are stored and secured in accordance with the data protection laws.

§2

Orders

  1. All the prices in the online shop genoscope.pl are given in PLN.
  2. Online shop genoscope.pl enables Customers to:
    1. place orders of product available on the online shop genoscope.pl and make contracts for distant sales
    2. gain information about products and services available on the online shop genoscope.pl.
  3. All information concerning products, namely catalogs, files, brochures, and other informational and advertising materials as well as information included on the website genoscope.pl are addressed to potential Customers and are not an offer in the legal reasoning, but just an invitation to start negotiations.
  4. Online shop takes orders through genoscope.pl. The orders are processed in the order in which they are received.
  5. Placing an order is synonymous with accepting it.
  6. Incase the option transfer-prepayment or online payment has been chosen, making payment on the account indicated by the vendor is considered to be the moment of concluding the contract.

 

§3

Delivery

  1. Products ordered on the online shop genoscope.pl will be delivered via one of the available carriers chosen by the Customer.
  2. Delivery time consists of:
    1. time needed to process the order (completing the goods, method of payment, preparing sale documents, packing)
    2. time of delivery (depends on the chosen delivery method)
  3. Unless stated otherwise, “GENOSCOPE” sp. z o.o. sp.k. hands over the product not later than 30 days since the day the contract has been concluded (the offer has been received by "GENOSCOPE" sp. z o.o. sp.k.).
  4. Invoices are issued with the date the goods are prepared to be sent (according to the sequence of incoming orders).
  5. Fiscal receipt and VAT invoice (unless e-invoice has been chosen) and for some products Producer’s guarantee are attached to purchased product. In case of lack of any of the mentioned documents the Customer should report it.
  6. At the moment of shipment delivery, Customer needs to assess the packaging of the shipment. Incase the shipment packaging is damaged or any shipment unit is missing, the Customer is obliged to undertake any actions necessary to determine the carrier's responsibility. In case of damage, “GENOSCOPE” sp. z o.o. sp.k. recommends to fill a damage report.

 

§4

Methods of payment

  1. "GENOSCOPE"sp. z o.o. sp.k. accepts the following forms of payment:
    1. Before delivering the goods:
      1. bank transfer
      2. credit card
    2. At the moment of pickup:
      1. cash in case of personal pickup in"GENOSCOPE"sp. z o.o. sp.k. physical stores
      2. cash handed to the delivery company member in case of choosing a delivery company
  2. “GENOSCOPE” sp. z o.o. sp.k. can arrange other terms and payment methods. In this case terms and payment methods indicated in the order confirmed by “GENOSCOPE” sp. z o.o. sp.k. obtain as accepted for processing and meeting additional requirements connected with agreed terms or method of payment.
  3. In case of selecting - as a method of payment – bank transfer or credit card, the customer should pay without undue delay. In case of selecting cash on delivery payment – at the moment of pickup.

 

§4

Return Policy

  1. The Consumer, who entered into a distance contract or an off-premises contract has 14 days to return an item without giving a reason and without incurring the costs except the cost defined in Article 33, Article 34(2) and Article 35 of the Act of 30 May 2014 on customer rights (Dz. U. [Journal of Laws] of 2017 No. 683). Consumer may return an item, providing a written statement of withdrawal from the contract.
  2. To comply with the 14-days deadline is enough to send a statement before its expiry.
  3. The time limit of withdrawal starts:
    1. in case of a contract where the entrepreneur gives an item and undertakes to transfer it's ownership - from the moment the Customer acquired, or a third party other than the carrier, physical possession of the good, and in the case of contract:
      • relating to multiple delivery, which is send separately, in lots or pieces  from the moment the Customer acquired physical possession of the last good, lot or piece,
      • for regular delivery of goods during a defined period of time from the moment the Customer acquired physical possession of the first good.
    2. for other contracts – from the day of concluding the contract.
  4. The Consumer should return the product immediately to the vendor, however, not later than 14 days from the moment of withdrawal from the contract.
  5. All return shipping costs are paid by the customer. "GENOSCOPE" sp. z o.o. sp.k. does not return additional shipping cost, that means other than the least expensive type of shipping offered by "GENOSCOPE" sp. z o.o. sp.k.
  6. Where a consumer exercises the right of withdrawal after having made a request in accordance with Article 15(3) and Article 21(2) of the above-mentioned of 30 May2014 on customer rights(Dz.U.[Journal of Laws] of 2017 No. 683), the consumer shall pay to the trader an amount which is in proportion to what has been provided until the time the consumer has informed the trader of the exercise of the right of withdrawal.
  7. Right of withdrawal from a distance or an off - premises contract does not apply toConsumer in situations defined in Article 38 of Act of 30 May 2014 on customer right, which are as follows:
    1. service contracts after the service has been fully performed if the performance has begun with the consumer’s prior express consent, and with the acknowledgement that he will lose his right of withdrawal once the contract has been fully performed by the trader.
    2. the supply of goods made to the consumer’s specifications or clearly personalized
    3. the supply of goods which are liable to deteriorate or expire rapidly
    4. the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery
  8. "GENOSCOPE" sp. z o.o. sp.k. does not use goods return policy.

 

§5

Quality guarantee

  1. "GENOSCOPE" sp. z o.o. sp. k. gives quality guarantee on sold products. Period of guarantee is counted from the date of purchase.
  2. Guarantor is liable for remedying the defect and, depending on the Complaints Department decision, replacement or refund.
  3. Proof of purchase from the retailer is required. This document should be attached in case of making a complaint on the basis of the guarantee granted by "GENOSCOPE" sp. z o.o. sp. k.
  4. Present guarantee applies to contracts concluded between "GENOSCOPE" sp. z o.o. sp. k., Warsaw, Ostrobramska Street 101, entered into the register of entrepreneurs kept by the District Court in Warsaw, XIII Commercial Division under KRS number 0000361515, NIP 1132808840, REGON 142495916, and Customers.
  5. The guarantee is valid only in the territory of Poland.
  6. Guarantee does not apply: after the period of guarantee has expired, in case of alteration or modifications made by anyone who is not a representative of "GENOSCOPE" sp. z o.o. sp. k. in case of replacing any of the parts by anyone who is not a representative of "GENOSCOPE" sp. z o.o. sp. k., to damages caused by using the product outside the permit or intended use, to damage caused by use of inappropriate maintenance, in case the defects arisen from: harmful radiation, mechanical injury, short circuit, in case of breaking or damaging the seals or product serial numbers or hiding them in such a way that it impossible to identify the product.
  7. Initiating the complaint procedure takes place when "GENOSCOPE" sp. z o.o. sp. k. receives the complaint and the faulty product. Then the Complaints Department verifies whether the fault was not caused by the Customer. "GENOSCOPE" sp. z o.o. sp. k. is obliged to consider the complaint within 14 business days.
  8. Ways of delivering the faulty product:
    1. Customer is obliged to send the product via forwarding firm.
    2. Customer delivers the product to "GENOSCOPE" sp. z o.o. sp. k. store on his own expense.
  9. If after the performed examination of the faulty product, "GENOSCOPE" sp. z o.o. sp. k. states that the guarantee terms were violated, especially if the product or its parts were modified, the Customer will be informed about this fact. The faulty product will be returned to the Customer (on his own cost and risk).
  10. The Customer will be charged with any costs borne by "GENOSCOPE" sp. z o.o. sp. k.
    "GENOSCOPE" sp. z o.o. sp. k. is not obliged to provide the Customer with a replacement product for the duration of the repair procedure.
  11. Faulty product delivered to "GENOSCOPE" sp. z o.o. sp. k. must be in its original packaging with all the included elements, documents. It is admissible to use a replacement packaging, however, it must guarantee proper protection during transport.
  12. This warranty does not affect the consumer's statutory rights under applicable national legislation in force, nor the consumer's rights against the retailer based on the warranty for physical defects.

§6

Claimprocedure

  1. If the product is faulty, "GENOSCOPE" sp. z o.o. sp. k. covers the costs of returns. The faulty product is verified by the Complaints Department. It verifies whether the fault existed at the moment of its release
  2. Transport of the products under guarantee is unconditional.
  3. Data on the label should have “REKLAMACJA” annotation.
  4. The product should have original packaging enabling proper protection during transport to technical service It is admissible to use a replacement packaging, however, it must guarantee proper protection during transport.
  5. The product should be sent with all elements which have an impact on its functionality or are the cause of its fault or the cause of non-compliance with the contract. It is advisable to include more detailed information about the fault of the product. Additionally, the Customer has to specify his guarantee expectations and their legal footing.
  6. The faulty product must be sent back with a proof of concluded contract (e.g. copy of sales document). In case of lack of these documents, "GENOSCOPE" sp. z o.o. sp. k. considers the complaint, if the sale is confirmed by "GENOSCOPE" sp. z o.o. sp. k.
  7. Way of delivering the faulty product - free shipment, Customer should use forwarding firm GLS (Poland) services. "GENOSCOPE" sp. z o.o. sp. k. does not return additional shipping cost, that means other than the least expensive type of shipping offered by "GENOSCOPE" sp. z o.o. sp. k.
  8. If the product isn’t collected after the claim procedure has finished, "GENOSCOPE" sp. z o.o. sp. k. has the right to charge the Customer for non-contractual storage.

§7

Final provisions

  1. In contacts with Customers, "GENOSCOPE" sp. z o.o. sp. k. uses devices for distant communication (e-mail, phone).
  2. "GENOSCOPE" sp. z o.o. sp. k. is allowed to entrust a third party (as a subcontractor) with processing the orders.
  3. "GENOSCOPE" sp. z o.o. sp. k. is liable for faulty items. Principles of liability can be found in the Civil code.
  4. "GENOSCOPE" sp. z o.o. sp. k. informs about out-of-court ways of considering claims. Access to these procedures is regulated by separate laws (e.g. Act of 15 December 2000 on Trade Inspection, Dz.U. [Journal of Laws] 2001.4.25 with further amendments).
  5. When selling non-consumable products vendor excludes liability under warranty.
  6. Within the meaning of Article 12(1) point 3 and 4 of the Act of 30 May 2014 on customer rights (Dz.U.2014.827), address biuro@genoscope.pl is not dedicated to contact in issues concerning concluded contract and complaints.
  7. Within the meaning of Article 12(1) point 3 and 4 of the Act of 30 May 2014 on customer rights (Dz.U.2014.827), telephone number: +48 22 213-07-29 is not dedicated to contact in issues concerning concluded consumer contract.
  8. Within the meaning of Article 30 (3) of the Act 30 May 2014 on consumer right (Dz.U.2014.827), "GENOSCOPE" sp. z o.o. sp. k. does not provide the possibility to send withdrawal forms online.
  9. Within the meaning of Article 8 (3) of the Act of 18 June 2002 on electronically supplied services (Dz.U. [Journal of Laws] 2002.144.1204 with further amendments). We inform that posting information with illegal content or contrary to public morality on our website is prohibited.
  10. Using our online shop genoscope.pl is possible if the Customer meets the following minimal technical requirements:
    1. Internet Explorer 10.0 later with enabled ActiveX, Java, Java Script and cookies or
    2. Mozilla Firefox version 34.0 or later with cookies enabled, Java, JavaScript and cookies,
    3. a minimum screen resolution of 1024 x 768 pixels
    4. in case of giving consent to receive e-invoice, software for opening PDF files is required, e.g. Adobe Acrobat Reader.
  11. Current content of terms and conditions is available on www.genoscope.pl.
  12. Terms and conditions do not affect Customer’s rights resulting from Act of 23 April 1964 of Civil Code (Dz.U. [Journals of laws] 1964.16.93 with further amendments) and Act of 30 May 2014 on consumer rights (Dz.U.2017.683).

 

§8

Right and effects of withdrawal

  1. Customer has the right to withdraw from this contract within 14 days without giving any reason.
  2. The withdrawal period will expire after 14 days from the day on which Customer acquires, or a third party other than the carrier and indicated by Customer acquires, physical possession of the goods.
  3. To exercise the right of withdrawal, Customer must inform “GENOSCOPE” Sp. z o.o. Sp. k. ul. Ostrobramska 101, 04-041 Warszawa, Polska of his decision to withdraw from this contract by an unequivocal statement.
  4. To meet the withdrawal deadline, it is sufficient for Customer to send his communication concerning his exercise of the right of withdrawal before the withdrawal period has expired.
  5. If Customer withdraw from this contract, “GENOSCOPE” Sp. z o.o. Sp. k. shall reimburse to Customer all payments received from him, including the costs of delivery (with the exception of the supplementary costs resulting from his choice of a type of delivery other than the least expensive type of standard delivery offered by “GENOSCOPE” Sp. z o.o. Sp. k.), without undue delay and in any event not later than 14 days from the day on which “GENOSCOPE” Sp. z o.o. Sp. k. are informed about Customer’s decision to withdraw from this contract.
  6. “GENOSCOPE” Sp. z o.o. Sp. k. will carry out such reimbursement using the same means of payment as Customer used for the initial transaction, unless Customer has expressly agreed otherwise; in any event, Customer will not incur any fees as a result of such reimbursement.
  7. “GENOSCOPE” Sp. z o.o. Sp. k. may withhold reimbursement until has received the goods back or Customer has supplied evidence of having sent back the goods, whichever is the earliest.
  8. Customer is only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
